Britney's Custody Victory: Weekly Overnight Visits With Kids

![]() Fame Pictures After a day of courtroom drama, a judge on Thursday afternoon granted Britney Spears one-night-a-week visitation rights with sons Sean Preston, 2, and Jayden James, 1. The visits, however, must be supervised by a court-appointed monitor. Late Wednesday, Spears' attorneys requested an emergency hearing to discuss overnight stays and the possibility of Britney's mom Lynne serving as the visitation monitor. When the hearing began at Los Angeles Superior Court at 8:30 a.m., Court Commissioner Scott M. Gordon questioned whether overnight visiting rights constituted an "emergency." Gordon told Spears attorney Anne Kiley, "Your client (Britney) made a conscious choice not to do anything that was ordered. That was a choice. That put us in this position." When Kiley responded that "it is an emergency for a 2 and 1-year-old to be with their mother," Gordon added that Spears' "substance abuse issues and emotional issues...could have devastating effects on the children." Lawyers for both Spears, 25, and ex-husband Kevin Federline, 29, then discussed the matter in the court's cafeteria and the judge's chambers. The hearing recessed at around 11:30 a.m. without any ruling from Judge Gordon, who instructed that the parties continue to deliberate outside of court. Rumors had swirled about Spears either sleeping through the morning hearing or avoiding it altogether, but the pop star showed up in court Thursday afternoon at her lawyer's request, according to Los Angeles Superior Court spokesman Allan Parachini. Arriving in a white Mercedes with media helicopters hovering above, Spears' appearance led to the day's second hearing, which began around 1:30 p.m. Wearing jeans and sunglasses, Spears was sworn under oath for testimony before the press was asked to leave. Parachini told reporters that Spears' voice was "soft and sweet." The closed-door hearing ended 41 minutes later, with Spears being granted one overnight visit a week. But the judge denied Spears' request that her mother play the role of court-appointed monitor. Federline's lawyer, Mark Vincent Kaplan, told Usmagazine.com that he was pleased with Spears' appearance. "I'm always pleased when anyone Spears and Federline are both due in court for another hearing on October 26. If Spears follows the directives issued in a court order on September 18 (including random drug and alcohol tests, parenting coaching and counseling) she could regain the joint custody of her sons that she and Federline once shared.
