Whoa, there! Brittny Gastineau stepped out in Los Angeles on Tuesday, June 10, with a massive black eye after getting into a physical altercation with Marquis Lewis, a famous street artist who goes by the name Retna, Us Weekly has learned.

In an interview with Us, Lewis' attorney Michael Goldstein explains the artist checked in to the London Hotel in West Hollywood on Tuesday, June 3, after undergoing major reconstructive knee surgery on Monday, June 2.

"Brittny visited him last Tuesday, the day he checked in," Goldstein said, "We don't know exactly what happened but [Lewis] …. was not the aggressor."

Retna's lawyer went on to dispel reports the artist attacked Kim Kardashian's BFF unprovoked. "Look, the guy was down and out—he had just had surgery—he was debilitated, lying in bed," he told Us. Goldstein added the artist even needed the assistance of crutches and a wheelchair to move about on his own.

As for reports claiming Retna was dating Gastineau, Goldstein tells us, "I don't know what the nature of their relationship was … but they were not dating at the time."

Retna will not be pressing charges, Goldstein claims, adding the artist holds no "ill will" towards Gastineau.

"He just wants to respect her privacy and he holds no ill will towards her and he chose not to get the police involved, even though he sustained injuries to his face, hand and ear," Goldstein tells Us.

As for Gastineau, the brunette was spotted out to dinner at both Mr. Chow and Craig's in Los Angeles following the incident on June 10. 

"Ms. Gastineau is still texting Mr. Lewis to this day," Goldstein says. "She continues to send him text messages and to call him regularly."
