Update: Jon Gosselin to Sue "Absentee Mom" Kate for Primary Custody of 8 Kids

Ex-spouses Jon and Kate Gosselin may be headed back to court.
An attorney for Jon, 33, plans to file an emergency petition this week in Berks County, Penn., for primary physical custody of his eight children with ex-wife Kate, TMZ reported Tuesday.
The reality dad's new lawyer Anthony F. List tells TMZ that Kate, 35, is "an absentee mom." List says her current stint on Dancing with the Stars prohibits her from spending "quality time" with twins Cara and Mady, 9, and sextuplets Aaden, Alexis, Collin, Hannah, Joel and Leah, 5. (Kate and DWTS partner Tony Dovolani have been rehearsing in the basement of the $1.1 million Wernersville, Penn. home she shares with her kids.)

Also on the docket: the child support situation. Currently, Jon pays Kate $22,000 a month in child support. The attorney charges that the fee is "ridiculous," and he may ask a judge to reverse the arrangement and demand that Kate pay Jon, though he declined to specify how much.
A source close to Jon tells UsMagazine.com that he "seems genuinely upset that the kids are growing up with strangers most of the time. Even when Kate's at the house, she has a nanny there to do all the work."

The source also adds that "Jon is anxious to find a place of his own close to the kids so he can have a little more stability for them," and has been house-hunting near the Wernersville house. He presently lives in a two-bedroom apartment on Manhattan's Upper West Side that rents for $5000 a month.

In February, cable network TLC reached a settlement with Gosselin in a breach-of-contract lawsuit. He remains under contract with the network, but is forbidden from making or profiting from unauthorized public appearances.

With this latest legal action, Jon "hopes this will move TLC to pay him or at least give him permission to go out and work...and be able to afford his new home." the source explains.
Update: Kate Gosselin's attorney Mark Momijan told RadarOnline, "we haven't received any formal filing yet but I can’t imagine anything farther from the truth. Kate is a devoted mother. Her concern for the welfare of her kids is so prominent that any allegations like this report are reckless and so far from the mark, it's offensive."

255No judge would give custody of those 8 kids to Jon. He is a lazy womanizer , who smokes pot and lives off rich women. The kids don't even like to spend time with him, he's too busy with his interests to even notice they are there. Kate is a great mom!!! The judge at the time of their divorce knew that, she got primary custody. Jon's last rich girl threw him out that's the only reason he wants the kids now, they are a meal ticket to him. He's broke and knows he can make money off of them. Jon needs mental help not the responsibility of taking care of 8 kids.
Kate is a terrible,cruel,greedy,selfish women. She can't even be considered a mom. Three nannies and loads of hired help along with Jon manage the kids and home. Kate who spends so many hours away spending money on tans, pedicures, nails, shopping, getting her done and redone says a lot about her. It was Kate who didn't want to keep the dogs because she needed a break. Of course she delegated the task to Jon to give the dogs back to the breeder. The kids are depressed, talking back to teachers, having to deal with their parents divorce in December 2009, all eight are in school and can't even be normal kids because Kate exploits them and their privacy for her own monetary benefit. Instead of being at home consoling their emotional needs and helping them developmentally she's jett setting off again. That says a lot about the lack of care and concern she has for her eight young kids. The kids aren't her primary focus. Through her choices the greed for money, freebies, attention, and stardom shows where her priority is, Kate and only Kate. Kate is abusive to Jon and the kids. It's all on video and appearances on tv slamming the kids father. Like Mady says she's the Queen Bee (when referring to Kate). In an interview Mady says she like's her dad the best. The kids look happiest when they are with Jon. The kids are neglected, deprived of their childhood, deprived of their privacy, exploited by Kate, can't even keep their pet dog because Kate wanted to be rid of them and they will forever have to overcome hurdles from being constantly put in the spotlight by their mom for the rest of their lives. They aren't lucky at all. Reality is they really live a deprive, sad, sad life. There is uproar over a picture of Kate's hand forcefully covering one of the little boys mouth. There's a video of Kate denying a thristy Mady water yet Kates takes a sip of water right in front of her daughter. One of the little girls got a whipping from Kate for blowing a whistle. On Jon & Kate Plus Eight Jon bathed, brushed the kids teeth, got them up and ready for school, walked them to the bus stop, was there to greet them when they came home from school, helped with the feeding, put together furniture and the list goes on and on. What did Kate do? Yell, complain, delegate, and bossed Jon around. He has been more hands on and nurturing than Kate will ever be. I hope he succeeds in his suit because Kate is an unfit mom and she is too busy counting all the dollar signs. Good luck Jon. You are the kids dad and have every right to have a say in the lives of your children.
Jon has done unthinkable things to his children. He moved to a different state and didn't include them in securing an apartment so they couldn't come for visitation and sleep over. He got and then returned their dogs, as an example of how he respects life, responsibilities and teaching life lessons to his children. He goes about his life by "playing" and not working. He sees the children sometimes, only when Kate is working (some of the time) to keep up with their support. Jon barely deserves visitation (although it's good for the kids), yet alone custody. How about some child support coming from a job. Kate is a typical good single mom. She is working as hard as she can to support them and has arranged her DWTS to be home as much as possible. Jon should kiss her tush for making up for his deficits. Custody: NEVER.

God what if something terrible happened to one of them, and you are jealous that Kate is doing well for herself and the children.
