Reese Witherspoon, Jim Toth Arrested for Disorderly Conduct, DUI

Reese Witherspoon and Jim Toth were reportedly arrested on charges of disorderly conduct and driving under the influence in Atlanta, Ga., on April 19.

Reese Witherspoon and her husband, CAA agent Jim Toth, were arrested early Friday morning in Atlanta, Ga., after law enforcement officers pulled them over for driving in the wrong lane, Georgia State Patrol confirms to Us Weekly. (Variety was the first to report the news.) According to a police report obtained by Variety, Toth, who was behind the wheel at the time of the incident, is facing a DUI charge; his Oscar-winning wife was taken into custody for disorderly conduct.

Variety reports that the couple was pulled after midnight on Friday, April 19, when an officer noticed their silver 2013 Ford Fusion weaving into the lane for opposing traffic on Peachtree Road in Atlanta, where the Devil's Knot star, 37, is shooting the indie drama The Good Lie. Witherspoon allegedly became agitated while her husband was being given a field sobriety test.

"Mrs. Witherspoon began to hang out the window and say that she did not believe that I was a real police officer," Variety quotes the police report as saying. "I told Mrs. Witherspoon to sit on her butt and be quiet."

The actress reportedly continued to spar with the arresting officer once Toth was in handcuffs, despite her husband's attempts to calm her down. "Mrs. Witherspoon asked, 'Do you know my name?'" the report supposedly states. "I answered, 'No, I don't need to know your name.' I then added, 'Right now.' Mrs. Witherspoon stated, 'You're about to find out who I am.'"

The report further explains that Witherspoon resisted when the officer grabbed her arms to put her in handcuffs. According to Variety, she and her husband were booked at a nearby station and released on bond a short time later, at approximately 3:30 a.m. They're due to appear in court on Monday, April 22, but sources tell the site the couple is expected to request a postponement. (They're currently in New York City for the premiere of her new movie.)

Reps for the actress declined to comment when contacted by Variety.
