Ryan Phillippe steps out after Reese Witherspoon's arrest in West Hollywood, California on April 24, 2013.

A break in the action! Ryan Phillippe has been on dad duty for the last several days while ex-wife Reese Witherspoon deals with the fallout from her arrest last week, but on Wednesday, April 24, he got the night off to meet up with friends in West Hollywood, Calif.

Dressed casually in gray pants, a black T-shirt, and a dark-blue baseball cap, the 38-year-old actor headed to L.A. eatery Craig's for dinner. It was the first time he had been spotted sans kids since before Witherspoon's run-in with the law in Atlanta, Ga., on April 19.

The Straight A's star and his ex — who married in 1999 and divorced seven years later in 2006 — have two children together, Ava, 13, and Deacon, 9. (Phillippe also shares daughter Kailani, 21 months, with model ex-girlfriend Alexis Knapp.) Both kids have been staying with their dad in L.A. while their mom does damage control following her and husband Jim Toth's arrests for disorderly conduct and driving under the influence. (Married for two years, the actress and CAA agent, 41, were arrested and briefly jailed after a policeman pulled them over for erratic driving, with an agitated Witherspoon arguing with the officer as Toth took a sobriety test.)

Witherspoon, 37, reemerged within hours after news broke of the incident on Sunday, April 21, when she hit the red carpet in New York City for the premiere of her film Mud. A short time later, she released a statement apologizing for her behavior.

"Out of respect for the ongoing legal situation, I cannot comment on everything that is being reported right now. But I do want to say, I clearly had one drink too many and I am deeply embarrassed about the things I said," she told Us Weekly in her statement. "It was definitely a scary situation and I was frightened for my husband, but that is no excuse. I was disrespectful to the officer who was just doing his job. The words I used that night definitely do not reflect who I am. I have nothing but respect for the police and I'm very sorry for my behavior."

One person she doesn't need to apologize to? Her ex. "Ryan doesn't care what she does. It's about the kids," a source told Us Weekly.

Phillippe is indeed a doting dad. The actor bragged about his daughter and son at an April 18 bash, telling Us, "At 13 and 9, it's pretty much all milestones."
