Custody of Dannielynn Still in Question

The Bahamian court adjourned on Friday with no decision having been made as to who will get custody of Anna Nicole Smith’s daughter, Dannielynn, the Associated Press reports.

The baby has been living in an oceanfront home in the Bahamas with Smith's former companion, Howard K. Stern, who is listed on the birth certificate as the father.

However, earlier this week DNA results proved that Smith’s former boyfriend, photographer Larry Birkhead, is the infant's biological father.

In a brief statement to the press, Stern, 38, acknowledged that the transition of custody has already begun, and that Birkhead has even taken on diaper duty, adding: "He's doing a great job.”

Attorney’s for Birkhead, 34, and Smith's mother, Virgie Arthur, met privately on Thursday.

Though Arthur calls Birkhead “a good guy,” her lawyer said that she still intends to fight for joint custody of her granddaughter.

"We intend to proceed on that application unless something else comes along that causes us not to have to take that course of action," attorney Debra Rose said.

When DNA test results were disclosed on Tuesday, Birkhead said he that would not share custody of the baby girl, but added, “I have no problem with anyone that has good intentions being allowed to visit the baby and see the baby and be a part of the baby's life.”

The former Guess model and Playboy Playmate died on February 8 of a drug overdose at the age of 39.

Meanwhile, the legal battle continues over the $500 milllion estate of Smith's late husband, oil baron J. Howard Marshall II, who died in 1995. It remains unknown how much money Dannielynn will receive and whether her guardian would have access to her inheritance.
