Howard K. Stern Gets The Boot

The owner of the house Anna Nicole Smith occupied in the Bahamas says he's so certain Howard K. Stern isn't Dannielynn's father that he's kicking Stern to the curb.

G. Ben Thompson bought the Horizons house in Smith's name with the understanding that the former playmate would eventually buy it – she never did. Now he wants to serve Stern with an eviction notice.

"We did this only after we found out that the courts directed that Howard K. Stern and the other parties seeking paternity take a DNA test. We know that Howard K. Stern cannot pass that test in any way that would suggest he is the father of that particular child," Thompson's attorney, Godfrey Pinder told Access Hollywood. "Once that is done, we know that he will no longer have any reason to be in the house because he will not be the child's father. He is not associated with the child in any way except maybe through the will which we believe is not necessarily a good will and therefore he will have to leave."

Even before Smith died last month at the age of 39, Stern, 37, and Smith's ex-boyfriend Larry Birkhead, 34, fought over paternity of 6-month-old Dannielynn. Earlier this week, a Bahamian judge ordered DNA tests to settle the matter. Results could possibly be released when court resumes on March 27.

To add insult to homelessness, Pinder said that if Birkhead or Smith's mom, Virgie Arthur, win custody of the 6-month-old, they might be allowed to live in the house.
