Joe Francis was "very surprised and in fact amazed" when he was told about the suit filed by Ashley Dupre, ex-New York Governor Eliot Spitzer's former call girl.
"It is incomprehensible that Ms. Dupré could claim she did not give her consent to be filmed by Girls Gone Wild, when in fact we have videotape of her giving consent, while showing her identification," Francis told Usmagazine.com in a statement Monday.
Dupre, 22, filed suit Monday seeking $10 million from Francis and his company, Girls Gone Wild, for misuse of her name and image for profit.
Francis had publicly offered Dupre a $1 million deal for a Girls Gone Wild photo shoot and tour but while he was haggling with her lawyers, he found GGW tapes of Dupre from 2003 and the deal was called off.
"She refused this offer and in fact if she’d like to reconsider, we’d be happy to discuss. She should keep in mind, it’s considerably more than the Governor of New York paid her, and our activities aren’t illegal,” he said Monday.
Asked in March about reports Dupre was underage during the GGW shoot, Francis said, "It doesn't matter."
He reiterated his stance on Monday.
“She’s seeking $10 Million for topless photos taken in front of a room full of people, including two newspapers and multiple crews we had in the room," he said. "These images were taken in public places and contain no sexual contact. We expect to triumph in this matter and continue to offer the best and hottest girls."
Francis' statement ended with a declaration that video of Dupre giving her consent will be available on-line imminently.

Is it just me or is that girl really ugly? Don't know how she can live with herself -- she should have crawled under a rock once she was exposed, and dealt with the shame in a more discreet way. She should go out and get a legitimate job like the rest of us. There are people working hours and hours to support their families, making an HONEST living. Anonymous 11:35: I don't think the laws applicable to the porn industry are applicable to JF videos. If they were, he might be in trouble with state and/or federal law. I agree with your statement that she probably will not get any money; however the state and or federal court is entitled to sue him if they feel he has violated any laws. Does anyone know if it is illegal to distribute a video with a minor once you are made aware that the person was a minor when they consented?

I may be a boring housewife now but I used to be quite the party girl in college and for a few years afterwards. I did Spring Breaks in Panama City, Cancun, Spain and Key West during my four years and spent several vacations in New Orleans. I never flashed anyone in any of these places because there were a million dirt bags with cameras all over the place looking to photograph boobs and I wasn't willing to humiliate myself or my family. She can't sue for her being trashy. JF does take advantage of stupid girls but the girls should know better than that. People need to take responsibility for their actions.

Im assuming her clientele has avoided her like the plague for fear of their trysts being broadcasted as well. Now she's looking for her next financial opportunity. Think about it...this is a girl who has always made her money in less than honest ways. Living the high life is all that motivates her and she will do whatever it takes to have it. Obviously she is trying to take advantage of what is deemed a 'gray area' (alcohol, being underage, he said/she said) and is hoping that will seal the deal for a quick 'payoff.' Whether a girl or guy, if you use fake id's to do things that you know you are too young to be doing then you should have to deal with the consequences. If you want to portray yourself as an adult then prepare to be treated as such. Dont go cry about it later because your arrogance got you in a dumb situation that is no longer 'cool' to you.

The question that will be presented before the court is whether JF can show this video and profit off it once he became aware that she was underage when it was filmed. In some porn cases, women used fake IDs in order to work. The producer was not penalized for the distribution while they were unaware of the age but were obligated to retired the videos once they became aware the girls had used a fake ID. In this case not only did JF not retire the video when he became aware she was underage but he decided to re market and distribute the video. I don't know what the law dictates with this type of video since it is not porn. Does anyone else know?
