Kevin Federline's Lawyer Holds Emergency Hearing in Custody Case

Hours after Britney Spears was rushed to the hospital on a gurney, Kevin Federline's lawyer, Mark Vincent Kaplan called an emergency meeting in the couple's ongoing custody battle Friday morning at L.A. Superior Court.

Spears' attorney, Tara Scott, was also present.

A rep for Kaplan told reporters, "Due to the circumstances, Mark Kaplan will not be making any statements to the media today."

A source tells Us Kaplan planned to ask the judge to strip Spears of visitation while she's on a 72-hour lockdown at L.A.'s Cedars-Sinai hospital. She has been labeled a "special needs" patient, a hospital source tells Us.

After she was taken to Cedars-Sinai Thursday (following a nearly three-hour custody standoff involving her sons), LAPD Officer Jason Lee told City News Service that Spears appeared to be under the influence of an "unknown substance."

Last September, Los Angeles Superior Court Commissioner Scott Gordon called Spears a "habitual, frequent and continuous" user of alcohol and controlled substances, and ordered her to undergo twice-weekly random testing.

Two weeks later, she was temporarily lost of custody of her sons; Federline now retains physical custody.
