Leo Gets Sued By Neighbor

Leonardo DiCaprio's neighbors are suing him for excavating land in what they claim is a negligent manner. Usmagazine.com has obtained court papers in which Robert and Joan Linclau allege that by excavating his property on Thrasher Ave. in Los Angeles, Leo, 32, has caused their land to cave in and slide.

Adding insult to supposed injury? The property on Thrasher is not where Leo lives, it's merely an extra lot he purchased to help keep his home on nearby Oriole Dr. more secluded. He used the space to construct a basketball court, at which point the Linclau's troubles began. According to court documents:

"On or about July of '04, defendants commenced construction of a basketball sports court on the property behind the defendants' home. In the process of construction, defendants entered plaintiff's property and cut and removed hedges and other plants that were the property of plantiffs and excavated earth granite and bedrock that was part of plaintiff's property...Defendants destabilized the hillside slope and in the process undermined the support of the plaintiff's deck and pool."

The suit against DiCaprio was filed in Los Angeles Superior Court on May 9th. The Linclau's are seeking unspecified damages from the Departed star, who is a noted environmentalist.

A rep for DiCaprio couldn't be reached for comment.
