Official Rules for Us Weekly’s FOX Fall Sweepstakes

Open to legal residents of the Continental United States. Entrants must be 18 or older as of 08/29/08.

How to Enter:

To enter the “Us Weekly FOX Fall Sweepstakes” (the “Sweepstakes”), email your full name, age, address and phone number to FOXFallSweeps@gmail.com. Limit one entry per person. Sweepstakes begins at 3:00 p.m. (Eastern Standard Time) on 08/29/08. All online entries must be received by 11:59 p.m. (Eastern Standard Time) on 09/19/08.

No mechanically reproduced or computer generated entries permitted. Not responsible for lost, late or misdirected entries, or entries containing incorrect or incomplete information. Not responsible for any problems or technical malfunctions of any telephone network or lines, computer, on-line, or Internet systems or services, servers, computer equipment, software, failure of any email or entry or confirmation or winners notice on account of technical problems or traffic congestion on the Internet, problems with the Usmagazine.com website, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer resulting from downloading any materials in connection with the Sweepstakes. Entries become the property of Us Weekly LLC (“Sponsor”) and will not be acknowledged or returned.

Winner(s):
One (1) Grand Prize Winner will be selected at random by Us Weekly staff (the “Judges”) in a drawing held on or about 09/22/08. Grand Prize Winner will be notified by e-mail or telephone. Odds of winning depend on number of eligible entries received.

Prize(s):
One (1) Grand Prize Winner will receive the following Prize package:
• round trip coach class airfare for Winner and a Travel Companion from Winner’s nearest major airport to Los Angeles;
• airport transfers to and from LAX to hotel;
• two nights’ stay at the Sheraton Hotel, Universal City (double occupancy);
• a set visit for Winner and Travel Companion to FOX’s “Terminator: The Sarah Connor Chronicles;” (the “Series”) and
• one FOX FALL Drama Prize Pack consisting of:
- one “Terminator: The Sarah Connor Chronicles” t-shirt;
- one “Prison Break” season three DVD;
- one “Prison Break” fleece sweatshirt;
- one “Fringe” poster;
- one “House t-shirt; and
- one “Bones” t-shirt.
The Approximate Retail Value (“ARV”) of the Prize is $2,150. Actual retail value of the Prize may vary. Winner is responsible for any expenses not expressly included in the prize description, such as additional ground transportation expenses, incidentals, meals, beverages, passport/visa fees and any other expenses. Winner’s travel companion must be 18 years old or older as of 08/29/08. Winner and travel companion must travel on same itinerary on dates designated by Sponsor and/or prize provider, and are solely responsible for obtaining passports. Winner and travel companion are subject to all rules and restrictions on the Series set and may be required to sign additional releases. The date of the set visit is to be chosen by prize provider and Series producers. If Series production is cancelled or postponed, or the set visit portion of the prize becomes otherwise unavailable, that portion of the prize may be cancelled without substitution or compensation therefor.

General:

Employees of Sponsor, Fox Broadcasting Co., Warner Bros. Television Production, their affiliates, subsidiaries, advertising or promotional agencies, immediate family members and/or those living in same household are not eligible.

No substitution or transfer of Prize permitted except as provided herein. Prizes are non-redeemable for cash. In the event of unavailability, Sponsor may substitute a prize of greater or equal value.

All federal/state/local taxes are the sole responsibility of prize winner.

Potential prize winners and their companion must execute an Affidavit of Eligibility/Release of Liability/Prize Acceptance Form within 10 days of notification. Noncompliance/return of prize notification as undeliverable will result in disqualification and selection of an alternate winner.

By participating in this Sweepstakes and accepting any prize, Winner agrees to release and hold harmless Sponsor, Fox Broadcasting Co., Warner Bros. Television Production, and each of their respective subsidiaries and related companies, and each of their respective officers, directors, employees and agents (collectively, "Released Parties") from and against any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Moreover, Grand Prize Winner’s travel companion must also sign a similar release in order to participate in the prize award. Without limiting the foregoing release, no Released Party shall be liable for any loss or damage to (a) any baggage or any unauthorized intervention whether or not caused by any action(s), regulation(s), order(s), or request(s) by any governmental or quasi-governmental entity(ies), equipment failure, including overloading of the website due to excessive use, threatened terrorist act(s), terrorist act(s), air raid(s), blackout(s), act(s) of public enemy, earthquake(s), war(s) (declared or undeclared), fire(s), flood(s), epidemic(s), explosion(s), unusually severe weather, hurricane(s), embargo(s), labor dispute(s) or strike(s) (whether legal or illegal), labor or material shortage(s), transportation interruption(s) of any kind, work slow-down(s), civil disturbance(s), insurrection(s), riot(s), or any other similar or dissimilar cause(s) beyond Sponsor’s sole and reasonable control; (b) damage caused by computer virus or otherwise resulting to any computers from any entrant’s access to the Sweepstakes website or entry into the Sweepstakes; (c) printing or other errors appearing in the rules or other Sweepstakes materials; (d) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from any entrant's participation in the Sweepstakes or receipt or use of any prize. Released Parties shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any performer(s)/event(s), air carrier(s), hotel(s), or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. The passenger contracts in use by the airlines or other transportation companies shall constitute the sole contracts with respect to the Grand Prize Winner's and his/her travel companion’s transportation and such contracts shall be solely between the Grand Prize Winner, his/her travel companion and such transportation companies. Released Parties shall not be parties to such contracts and shall assume no responsibility in this connection. Released Parties shall not be liable for any loss, theft or damage of cash, cameras, jewelry, securities, heirlooms, negotiable papers or other valuables. If the Grand Prize Winner becomes disabled or cannot otherwise fully enjoy the Grand Prize travel package due to illness, Sponsor shall have the option of: (1) being relieved of liability for fulfillment of the Grand Prize award; or (2) at Sponsor's sole discretion extending the period during which the Grand Prize may be awarded for a period equal to the duration of the Grand Prize Winner's disability or illness, in which case certain prize components may not be available. The Grand Prize Winner must prove such disability by a doctor's certificate, which certificate shall be endorsed by another physician agreeable to Sponsor and Grand Prize Winner at Sponsor's expense. Sponsor's failure to enforce any term of these rules shall not constitute a waiver of that provision; you further agree that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorneys' fees and/or experts' fees and costs. By participating in the Sweepstakes, you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

Acceptance of any Prize constitutes consent to use winner’s and winner’s companion’s name and likeness for editorial, advertising and publicity purposes in all media, whether currently existent or hereafter derived, without additional compensation, except where prohibited by law.

Us Weekly reserves the right to disqualify any person tampering with the entry process, the operation of the Usmagazine.com website, or who is otherwise in violation of the Official Rules. Us Weekly further reserve the right to cancel, terminate or modify the Sweepstakes in the event the Sweepstakes is not capable of completion as planned, including infection by computer virus, bugs, tampering, or technical failures of any kind. In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the Sweepstakes at the actual time of entry will be deemed to be the entrant and must comply with these Official Rules. Authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, on-line service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address. CAUTION: ANY ATTEMPT BY ANY PARTICIPANT TO DELIBERATELY DAMAGE THE USMAGAZINE.COM WEBSITE OR TAMPER WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, US WEEKLY RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH ENTRANT(S) TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION.

By participating, entrants agree to be bound by these Official Rules and the decisions of Us Weekly, which shall be final and binding with regard to all matters relating to the Sweepstakes.

Any dispute arising from this Sweepstakes will be determined according to the laws of the State of New York, without reference to its conflict of laws principles, and the entrants consent to the personal jurisdiction of the State and Federal Court located in New York County and agree that such courts shall have exclusive jurisdiction over all such disputes.
