UPDATE: Shia LaBeouf Won't Be Charged Due to "Insufficient Evidence"

 Entertainment Press / Splash News Actor Shia LaBeouf won't be charged with a DUI stemming from his July car accident but his license could be suspended for refusing a breathalyser test. The L.A. County District Attorney had "insufficient evidence" to charge the Transformers star, a spokeswoman told the Associated Press on Thursday. California's Department of Motor Vehicles met with LaBeouf's attorney on Friday and decided to postpone a hearing addressing the suspension of the star's driver's license. The hearing is now set for Oct. 29. "Shia is most happy that he will not have to go to court," his attorney, Michael Norris, told the AP. "I anticipate that once we do have the opportunity to litigate the matter at the DMV that his license will not be suspended." Two other people involved may be charged for the accident, which badly injured LaBeouf's hand and required days of hospitalized. See Us' celeb mug shot archive. The accident occurred in West Hollywood on the morning of July 27. Sheriff's deputies had previously determined that LaBeouf was not at fault; the other driver apparently ran a red light Earlier this month, LaBeouf said the crash was "eye opening and terrifying. "The car hit me at 70 mph," he told Entertainment Tonight. "It was one of the biggest things that's happened to me, for sure, in my life," he added. "I'm grateful to be here." So he gets away with it this time. Pray for the family of the person he is going to kill next time he drives drunk. He has admitted to having a drinking problem, this leopard is not going to change his spots because of a close call like he had.

He refused a breath analyzer but they did do a BAC through the hospital. It is the results of that test that made them drop the charges as insufficient. Shia probably got PO's that he was the victim and bleeding and they were saying they thought he was drunk..probably told them where to shove their breath analyzer. WHICH shouldn't have been done at the scene anyway since he was going to be transported to the hospital and standard procedure would call for a BAC. The cops ASSUMED he caused the accident, ASSUMED he was drunk.. they were unable to prove they were right by the results of his BAC and their own investigation proved he didn't cause the accident.. so now they have to suck up and admit they were wrong..which means he is free of the DUI charge. They will try to get him for refusing to cooperate at the scene..but his lawyer can claim that he was hit by a car doing 70 mph through a red light, he hit his head and injured his hand and was disoriented and felt he was being harassed. And a breath analyzer is not within protocol when someone is going to be transported to the hospital for injuries anyways. At the most they will take his license for 9 months with a to and from work provisional license which is actually the exact same penalty if he was found guilty of a 1st time misdemeanor DUI..go figure.

I disagree with your refusing a breathalyzer advice. I got a DUI this spring and when I refused my breathalizer, they took me to the hospital, pinned me down and drew blood. They will bust you either way if you are not a celebrity!

That is correct. You can refuse a breathalyzer. You're license will be suspended but they can't charge you with a DUI because there is no proof you are drunk. So it's not smart to drink and drive, but if you do, refuse the test because it's better to get your license suspended then get your license suspended and get a DUI.

Actually 8:41, you are incorrect on that. Anyone can refuse to submit to a breathlyzer, it is your right to do so, but the police don't have to tell you that. But if you DO refuse to submit, you risk having your license suspended on "suspicion" of drunk driving. Most times, your car will be towed and you could still be arrested on related charges. I'm married to a police officer and have been a cop reporter for a newspaper for 10 years, I know what I'm talking about when it comes to stuff like this. It's just smart not to drive drunk in the first place!!
