Nicole Richie’s trial regarding her December arrest for driving under the influence has been rescheduled for August 16, and the court has ordered that Richie be present.
The trial was originally scheduled to take place on Wednesday. However, after a meeting with Richie’s attorney, Shawn Chapman Holley, Commissioner Steven K. Lubell granted Holley’s request for a continuance because Dr. Terence McGee, a drug expert who is going to testify on Richie's behalf, is out of the country and wouldn't be able to appear in court until August 6, at the earliest.
"He can speak to the lack of reliability of urinalysis testing," Holley told Lubell. "He is crucial to her defense. If he is believed, and I believe he will be, than Richie will be acquitted."
Lubell doesn’t plan on budging on the August 16 hearing.
"I am ordering Richie to be here on that date," Lubell said. "And I would like the trial to start on that date."

I'm not sure what kind of defense move that is supposed to be. If she was found driving the wrong way on the highway, doesn't that say enough? And would everyone just stop talking about her sentence potentially being postponed due to a pregnancy!!!???!!! Pregnant women are sentenced to jail everyday! She would receive the necessary medical care in jail and her baby would be fine. She did something wrong and now it is time for her to talk what is given and deal with it.

The mandatory minimum here is only 5 days, I believe. Thats not that big of a deal. Paris was supposed to do 30 and only served 23. The 5 days will probably only turn into 2 or 3. Thats if she gets convicted. There are lots of ways to keep out statements made at the scene and "unreliable" tests.

First of all, she is not the one in control of her court date, her lawyer is. And secondly they need Dr. McGee for the trial to be fair and just. Every person in America has the right of attorney, it's not Nicoles fault she can afford a good one. I'm not saying she should not be punished, but a year in jail is far to extreme for pot and vicodin.

That defense will go over will well. Telling the judge that the practice of drug testing the each jurisdiction relies on for probation, health, and arrests is unreliable. Good luck with that! Will he also testify that urinalysis made Nicole tell the police that she was on Vics and had smoked weed? Or that it made her drive the wrong frikkin way on the road? She was ok admitting she was under the influence until she knew it was mandatory jail time. I hope the prosecutors pull out her interviews.

Seems only fair that if she is found guilty that they take at least as strong of a stance on her sentence as they did Paris because aren't they technically guilty of about the same thing? So she should get her license suspended and put (if it isn't already) and sentenced up to 30 days in jail which she must serve. I would then hope that she isn't going to be doing anything after that to harm her baby as that would really show a side of irresponsibility that I hope she does NOT have. AND if for some reason they choose to postpone her actually going into jail for her sentence till after the baby is born due to health reasons I hope that they make her serve every day of her sentence. The hollywood crowd need to learn that breaking the law means you get punished for it....why not....everyday Joe's have to own up to and be punished for what they do wrong why should anyone from Hollywood be treated any better when they aren't?
