Nicole Richie will decide Wednesday whether or not to accept a plea deal offered by prosecutors in her driving-under-the-influence case, according to a court spokesman. The terms of the deal have not been made public.
Richie’s attorney, Shawn Chapman Holley, is expected to appear on behalf of her client and either accept or reject the plea deal, Allan Parachini, a spokesman for the Los Angeles County Superior Court, tells the Associated Press.
Richie, 25, is not required to attend the court hearing because she faces a misdemeanor charge. In fact, The Simple Life star is not even in the country at the moment. She left L.A. on Monday for Calgary, Canada, where boyfriend Joel Madden performed a concert with his band Good Charlotte.
On Tuesday, Holley requested that the L.A. Superior Court postpone the trial because one of her witnesses would not be available until early August.
The Superior Court commissioner told her to submit motions on Wednesday, when Richie's trial was originally scheduled to start.
Authorities arrested Richie on Dececember 11 after witnesses reported seeing her SUV headed the wrong way down a California highway. She allegedly failed a field sobriety test and admitted to having smoked marijuana and taken a Vicodin.
In February, Richie pleaded not guilty to misdemeanor driving under the influence. She had a prior misdemeanor DUI conviction in June 2003.
The California Vehicle Code states that, if a person is convicted of DUI twice within 10 years, they can be sentenced to between 90 days and a year in jail and have their driver’s license revoked.
