SUPER MILLION DOLLAR XVI SWEEPSTAKES
Winner will be determined by comparing individual sweepstakes numbers on all eligible entries received with the pre-selected winning number. Selection of winning number will be conducted under the supervision of an independent judging organization whose decisions are final. If the winning number is returned, winner notification will be made on or before 7/30/10. IF WINNING NUMBER IS NOT RETURNED, PRIZE WILL NOT BE AWARDED. Sweepstakes open to legal U.S. residents (except residents of Florida), and to residents of other countries and U.S. territories and possessions only where offered and permitted by law. Void in Florida and where prohibited by law. This offer will NOT BE MAILED into Texas.
CONSUMER DISCLOSURES: You have not yet won. No purchase necessary. One prize of $1,000,000, if claimed, will be awarded as an annuity of 30 annual installments of $33,333.34 (current value of annuity as of 08/26/08 was $557,176), OR winner may choose $500,000 lump sum cash. Odds of winning are 1:130 million. Illegible, incomplete, mutilated, postage due or mechanically reproduced entry forms or entry forms that have been tampered with or not obtained through legitimate channels will be disqualified. Liability for an irregular entry form, sweepstakes number or sweepstakes notice will be limited to replacement with another. If, due to a printing, production, technical, human or other error of any nature, more than one valid entry form with the pre-selected winning number is returned, a random drawing will be conducted by Ventura Associates, Inc., whose decisions are final, from among all eligible, validated and non-suspect entries received with the pre-selected winning number to determine one winner. Ventura Associates, Inc., shall always have the right to take such other measures as it deems necessary or appropriate in its sole discretion to preserve the integrity of the Sweepstakes. In no event shall Ventura Associates, Inc, and/or Presenting Promoters have any liability or obligation to award more than the one prize stated above.

No mechanically reproduced entries. No responsibility assumed for lost, late, misdirected, mutilated, damaged, incomplete, illegible or postage-due mail/entries. All such entries will be disqualified. All entries become property of their respective Presenting Promoter & will not be returned or acknowledged. Participating entrants agree to these rules and the decisions of the Judges and the Presenting Promoters, and release the Judges and the Presenting Promoters and their respective parents, subsidiaries and affiliated companies, and all other businesses involved in this sweepstakes, as well as the employees, officers, directors and agents of each, from all claims and liability relating to their participation, acceptance, use, and or redemption of prize. Winners assume all liability for any injury or damage caused or claimed to be caused, by participation in this sweepstakes or acceptance, use or redemption of any prize. Presenting Promoters and Ventura Associates, Inc. are not responsible for any printing, production, typographical, human or other error of any nature in printing of the sweepstakes notice, entry form or prize notice, or administration of the sweepstakes or in the announcement of the prizes. Any sweepstakes notice, entry form or prize notice containing a printing, production, typographical, human or other error of any nature shall be deemed null and void. Ventura Associates and any of the Presenting Promoters are not liable for payment of any prize to entrants who have violated these official rules. Winners acknowledge that the Judges, Presenting Promoters and all other businesses concerned with this sweepstakes and their agents do not make, nor are in any manner responsible for any warranty or representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of any merchandise prize except that such prize shall be subject to manufacturer’s standard warranty.
A winner may be required (at judges' discretion) to sign & return an Affidavit of Eligibility/Liability Release, & where legally permissible, a Publicity Release within 14 days of date on notification. Failure to execute and return any required documentation within the time period specified and/or return of any prize notification or prize as undeliverable may result in disqualification and selection of an alternate winner. Acceptance of a prize by a minor will require execution by parent or legal guardian of required documentation. Costs for goods or services not specified are winner’s responsibility. No substitution of prizes except by Presenting Promoter due to unavailability. Except where prohibited by law, winners consent to use of their names, hometowns, prizes won & likenesses for promotional purposes on behalf of all Presenting Promoters without additional compensation. Void where prohibited by law. All federal, state, provincial & local laws & regulations apply. Prize values awarded in U.S. currency. No transfer or assignment of prize permitted except to a surviving spouse. Winners responsible for all taxes on prizes. U.S. laws govern all aspects of this sweepstakes. All disputes and claims arising out of or relating to this Sweepstakes shall be determined according to the laws of the State of New York without regard to its conflict of law principles and all participating entrants consent to the personal jurisdiction of the federal and state courts located in New York County and agree that such courts have exclusive jurisdiction over all such disputes. All causes of action arising out of or in connection with this sweepstakes shall be resolved individually without resort to any form of class action litigation and any and all claims, judgments and awards shall be limited to actual out of pocket expenses incurred.
Winner selection executed at 1040 6th Ave., NY, NY 10018. Ventura Associates, the independent judging organization, has provided all prizes at no charge. Ventura Associates, Inc. and/or Presenting Promoters reserve the right to modify, suspend, or terminate the promotion if it becomes technically corrupted. In such event, prizes will be awarded (if applicable) from eligible entries received prior to this date of termination. Employees of Presenting Promoters, Ventura Associates, Inc., their respective advertising & promotion agencies & any other person or organization directly involved with the promotion & their respective immediate families and/or household members of such employees are ineligible. Entrant information provided to judging agency will solely be used by judging agency in process of determining winners for this promotion, and will be destroyed thereafter.
If offered in Canada, Canadian residents, to win, must first correctly answer, unaided, a time-limited mathematical skill testing question administered by mail. Any litigation regarding the conduct & awarding of a prize in this publicity contest by a resident of the province of Quebec may be submitted to the Regie des alcools, des courses et des jeux.
