Another uphill battle for Kelly Rutherford. A judge has halted plans for her two children to return to the U.S. just days after the Gossip Girl actress was granted temporary sole custody.
According to the Associated Press, Rutherford's ex-husband, Daniel Giersch, is claiming that the star made "fraudulent statements" and "lied" in order to get custody of their son Hermes, 8, and daughter Helena, 5.
In addition, Giersch's attorney is arguing that Monaco, and not California, has jurisdiction over the children. Therefore, the kids can not return to the U.S. until Monaco and L.A. judges discuss the situation at a custody hearing on June 11.
Rutherford, 46, and entrepreneur Giersch divorced in 2009, and have been battling for custody for six years. Hermes and Helena have been with their father in France since 2012, and it was decided in December 2013 that Giersch no longer had to pay for the kids to visit the States.
The actress has tearfully shared her story in interviews, and has received support from her Gossip Girl costars Ed Weswick and Matthew Settle, and even Kim Kardashian during this troubling time. Earlier this month, the stars and thousands more signed a White House petition to bring back Rutherford's kids.
