Lots of XO’s for these two! Kelly Ruthford finally reunited with her two children in NYC on Friday, July 3, amid a nasty custody battle with her German ex-husband Daniel Giersch, Us Weekly can confirm.

The Gossip Girl actress was photographed with her son Hermes, 8, and daughter Helena, 6, outside an apartment building in the afternoon. The adorable tots each carried a pillow and looked on as Rutherford got a kiss from her boyfriend Tony Brand.

A source adds to Us that Rutherford, 46, and her children also seemed “really happy” as they spent time together outside the Italian restaurant Sant Ambroeus on Saturday, July 4.

Rutherford won temporary sole custody of her children in May — but the fight isn’t over yet. Hermes and Helena will have to return to Monaco after the summer.

Rutherford and Giersch have been battling over custody for six years. (The pair split in 2010 after four years of marriage.) Hermes and Helena currently live full-time with Giersch in France. Giersch has refused to come back to the U.S., and it was decided in December 2013 that he no longer had to pay for their children to visit the States.

“I know it’s not right. Parents know — everyone knows it’s not right,” Rutherford, who has reached out for celebrity support, told Good Morning America on April 14. “I can sit here and tell you how often I cry. I can tell you how it feels to leave my kids in a foreign country and seeing them after not seeing them for weeks on end. Not being able to bring them from school and pick them up from school, dress them, hug them, smell them.”

She added: “My children, not only were they taken away, but they were sent to a foreign country. I don’t even know how you explain to someone what it feels like.”
