A college student in California was arrested after he was accused of raping a 12-year-old girl in his dorm room and ordering Plan B from DoorDash.

Andres Manuel Aguilar, a student at Menlo College in Atherton, California, has been charged with two counts of sexual assault of a juvenile and one count of providing marijuana to a juvenile.

The incident took place when Aguilar, 19, allegedly approached the child at a bus stop on May 4.

“He comes up to her, starts talking to her,” San Mateo County District Attorney Steve Wagstaffe told People on Thursday, July 9, about the alleged interaction. “She told him she was 17 years old, but he knew she wasn’t that old.”

Wagstaffe said that Aguilar and the minor exchanged texts and arranged to meet up the following day at a bus stop across from Menlo College.

“She sneaked out from her home and went to meet with him,” he said, claiming that the pair walked to a store and left with “some beer and rum.”

Aguilar then allegedly brought the girl back to his dorm room, where the reported sexual assault took place.

“He then became worried about pregnancy, and he called DoorDash to deliver Plan B prevention,” Wagstaffe claimed. “He gave it to her and then he allowed her, he said, ‘OK, you can go home.’ And she told her mother when she got home and her mother took her to Stanford Hospital and of course the people at Stanford called the police.”

After the incident was reported, Aguilar was arrested at the dorm on May 12.

“The police did their investigation, did all their interviews, got our victim over for a forensic interview as we do with these cases,” Wagstaffe said.

Investigators are still looking to see if Aguilar has any other potential victims.

“It was continued because there is a possibility that we have a second victim,” Wagstaffe said of the investigation. “The police are investigating that. That’s an ongoing investigation … But at this point, it isn’t like we have a second victim.”

The victim’s mother has also publicly spoken out about the incident, telling KRON 4 that other potential victims should be encouraged to come forward.

“If you know this man, if you’ve had any negative interactions of him, or if you are a victim of rape by him, come forward,” she said.

Aguilar’s preliminary hearing is scheduled to take place at the end of August. It is not currently clear if he has entered a plea or retained legal counsel.

If Aguilar is found guilty, he could face a maximum sentence of life in prison.

“If a child is 13 and under, society treats that much more seriously,” Wagstaffe told KRON 4. “The penalties are much higher. There is never any argument that a child could have consented in any fashion to it, and it really becomes serious when you deal with a 12 year old child.”
