The incident took place when an Uber Eats delivery driver arrived at an apartment building and delivered food to a woman in the lobby around 2:35 a.m., according to the arrest complaints viewed by the outlet. The driver told police he “engaged in a brief conversation with her” and “took a liking to her.”

The driver returned to the apartment complex about an hour later “in an attempt to see the witness again and possibly obtain her phone number.” However, he wasn’t able to find her and decided to leave.

As the driver approached his vehicle, Saruultuya allegedly gave him “loud verbal commands to lie on the ground” and pointed a gun at him. Police said that the driver then got on the ground as Saruultuya fired a single round, with the bullets grazing the victim on his right buttock.

As the driver remained on the ground, Saruultuya allegedly “struck him on the back of the head” with the buttstock of the handgun, resulting in a two-inch open wound. Saruultuya then allegedly instructed him to stand and he continued to point his gun at him as he declared, “I am going to kill you.”

The driver told police that he heard the woman “pleading” with Saruultuya and asking him to “please stop,” according to the arrest report. Saruultuya then allegedly “chased” the driver as the woman attempted to “hold him back.”

The driver managed to leave the scene and drove to a local hospital, where he spoke with authorities as he was treated for his wounds. Later on, the driver identified Saruultuya as his attacker from a photo array.

Authorities said that they learned Saruultuya’s license plate information through an anonymous tip that someone submitted after they witnessed the alleged incident. They then tracked him to his residence and arrested him.

After Saruultuya was taken into custody, police searched his apartment “to make sure there were no other subjects inside the premises.” As they looked through his home, officers found a “large quantity of white pills” and oxycodone tablets “in plain view.”

Authorities then obtained a search warrant and allegedly found large quantities of several controlled substances, which included cocaine, ketamine and psilocybin mushrooms.

Saruultuya was booked into Turner Guilford Knight Correctional Center at 10:53 p.m. on October 12, and he appeared in court on Tuesday, October 13, according to WSVN 7 News. When the judge asked him about the substances found at his home, Saruultuya said that “those are my prescriptions.”

Saruultuya, who goes by Khan online, is a fitness influencer that has 17,000 followers on Instagram. His account has been set to private as of Thursday, October 15.
