A Florida man was arrested after he allegedly choked his ex-girlfriend before he dumped a backpack filled with feces, urine and hot sauce on her after she cheated on him.
Daniel Niemiec was charged with domestic battery by strangulation and two counts of domestic violence battery following the incident that took place in early June.
The Coral Springs Police Department launched an investigation into the matter on July 1 when the victim’s brother sent an email to authorities reporting the assault, according to a probable cause arrest affidavit viewed by Law & Crime.
Investigators spoke with the victim’s mother, who said that her daughter made the allegations against Niemiec, 20, when she texted her around 2 a.m. on June 2. “I love him but he just hurt me he choked me out and hit me,” the victim’s text message read, per the affidavit.
Officers also spoke to the victim, who said that she experienced multiple incidents of alleged abuse at the hands of Niemiec. The victim recalled one incident in which she was having consensual sex with Niemiec at his apartment when he allegedly slapped her in the face multiple times and continued to do so even when she asked him to stop. She said that the slaps caused “redness and pain,” and she sent photos of her injuries to her mother.
Niemiec spoke to police after he received his Miranda rights, and he claimed he was “testing something new and did not know the limits of the situation” when asked about the particular incident. He also claimed to authorities that he did not hear the victim telling him to stop.
During a separate incident on June 30, Niemiec allegedly used two hands to choke the victim when they got into an argument. He allegedly prevented her from breathing and she gasped for air when he let go. Police added that Niemiec was allegedly “laughing” as he choked her, per the affidavit.
Niemiec admitted he choked the victim and told officers that he “has anger issues and sometimes he cannot control it.”
The defendant allegedly poured the bag full of human waste on the victim on July 1. At the time, the victim and a friend met with Niemiec at his apartment and he allegedly came outside with her belongings. He then reportedly emptied the backpack onto her, which police said was filled with urine, feces, hot sauce, ketchup and other unknown fluids.
Niemiec allegedly admitted to police that he threw the backpack at the victim. However, he said he “could not recall whether the items landed on” her. The defendant also told authorities that he committed the act as “payback for her cheating.”
Niemiec was arrested and taken to the Broward County Jail, where he has since been released after he posted a $4,000 bond.
It is not currently clear if Niemiec has entered a plea or retained legal counsel following his arrest. The Coral Springs Police Department did not immediately respond to Us’ request for comment regarding the case.
