He'll walk away winning. Brian Austin Green will most likely get spousal support in his divorce from Megan Fox, TMZ reported on Monday, Aug. 24, and it's because of a medical condition.
Fox filed divorce documents last week, a day after Us Weekly broke the news that she and her husband of 5 years had separated. In her papers, the Teenage Mutant Ninja Turtles actress, 29, cited irreconcilable differences, and is seeking joint physical and legal custody of their sons Noah, 2, and Bodhi, 18 months.
Sources told TMZ on Monday, that Fox will likely have to pay the Beverly Hills, 90210 hunk spousal support due to the startling disparity in their respective incomes. The site reported that Green, 42, has not been able to work as much since he and Fox were involved in a head-on collision last December.
The scary incident was caused by a drunk driver who crossed lanes and hit their Range Rover. The accident allegedly left Green with vertigo, and the medical condition has left him mostly bedridden and unable to work, TMZ reports.
"It could have ended horribly. We were talking about it today, on the way to run errands. I was saying, 'We're really lucky,'" Green told Us in the days following the accident. "He was going 50 miles an hour, and we were going 25 down the street, and we hit head-on. The inertia of that is life changing. That's life changing for us."
Meanwhile, sources revealed to Us that Fox and Green decided to split six months ago.
“Things have been rocky,” one insider told Us about the pair, who met in 2004 and wed in 2010. Another source added that Fox is extremely "independent" and has "gone off and done her own thing recently."
In the wake of his divorce news, Green was spotted out in L.A., pumping gas last Friday, Aug. 21, with his wedding band still on his left ring finger.
