Kim Zolciak’s Son KJ, 15, Asks to Be Released on Bond After Assault Arrest, Faces 50 Years in Prison

Kim Zolciak’s 15-year-old son, Kroy “KJ” Biermann Jr., filed a legal petition to be released on bond while awaiting court proceedings following his arrest for sexual assault.

KJ’s attorneys requested the teenager’s release on Wednesday, September 2, according to court documents obtained by Us. Per the docs, KJ’s legal team claimed that their client is not a flight risk and cited his academic and athlete record as evidence of his good character. (TMZ was first to report the news.)

The lawyers further noted that KJ has strong ties to the local community, including his parents and his siblings. (Zolciak, 48, and estranged husband Kroy Biermann share KJ, Kash, Kaia, Kane. Biermann, 40, also adopted the Bravo’s stars daughters from a previous relationship, Brielle and Ariana.)

“His ties to his family and community are substantial. His parents live separately, and he maintains a home and relationship with each,” his court docs state. “Beyond his immediate family, he is surrounded by an established community of extended family, friends, coaches, teachers and others who remain actively involved in his life and continue to support him and his family during the pendency of these serious allegations.”

KJ was arrested in Alpharetta, Georgia, on August 17 for aggravated sodomy and aggravated sexual assault. A judge did not immediately set bail, remanding KJ to the Metro Regional Youth Detention Center until a court hearing held Tuesday, September 8.

A source previously confirmed to Us that Metro Regional Youth Detention Center is essentially a holding center and KJ spends most of his day doing school work and homework. “He’s doing the best he can at the moment. He does want to go home. He calls his mom every day,” the insider shared with Us. “Kim can’t wait until he gets home and is praying to God this is over soon.”

The lawyers further stated in their Wednesday motion that KJ faces two felony charges that each carry mandatory minimum sentences of 25 years. If found guilty on both counts, KJ could possibly be sentenced to 50 years of incarceration.

Per his lawyer, KJ’s familial ties allegedly “bind him to his home, his school, his family and this community” that seemingly prove he wouldn’t leave before trial.

“They provide structure, supervision, accountability, and compelling reasons for him to remain here and comply with every condition imposed by this court,” the docs state, further alleging that KJ found out about the accusations in April and subsequently submitted to a polygraph test without fleeing the state. “He did not violate the laws of any municipality, county or this stage. He continued attending summer school activities and living at home with his family.”

KJ’s attorneys also requested the court to seal court records and proceedings due to the teen’s juvenile age.

KJ, for his part, has vehemently denied the accusations.

“First and foremost, this is not the kind of information that should be for public dissemination. These are juveniles,” KJ’s attorney Jason Sheffield said in a statement shared with Us last month. “Secondly, my client is 100 percent innocent and tried to present evidence to the arresting officer, including a passed polygraph by a notable and respected sex offender polygrapher.”

Sheffield continued, “Additionally, the officer’s report notes the GBI [Georgia Bureau of Investigation] found no male DNA on or inside the areas the alleged victim claimed she was assaulted. Had the officer sat down with me, I feel certain she would’ve never made an arrest.”
