A police report has revealed the alarming details of Kroy “KJ” Biermann Jr.’s alleged crimes after the son of Kim Zolciak and Kroy Biermann was arrested for sodomy and sexual assault.
The alleged incident occurred on April 23 at Lifetime Fitness in Alpharetta, Georgia, according to the report obtained by Us on Friday, August 21. The minor female victim, who Us has chosen not to identify, reported an aggravated sexual battery and aggravated sodomy and was taken to the hospital.
The victim reportedly had a regular chiropractic appointment at the gym. After learning that the chiropractor was not in the office that day, she opted to work out instead. Later, while eating in the gym’s café, she saw a friend — later identified as KJ, 15 — enter the facility and called out to him.
The pair began talking, at which point KJ allegedly “asked if she wanted to go into the coed sauna with him,” per the report.
The victim told police that she and KJ had been “friends for some time” in high school. She also described KJ as a “flirty” and “joking person.”
According to the victim, KJ “was making jokes and flirting” with her as they walked to the family locker room. Once they arrived in the room, KJ allegedly asked the victim to kiss him multiple times.
“He grabbed her by the waist and started kissing her neck and grabbing her butt with his hand and an open hand and kissed her lips,” the report read, claiming KJ also touched her private area on the outside of her pants, and she “froze.”
The victim stated that she told KJ “no” multiple times during the alleged incident, and he allegedly “said something to the effect that she was lucky he wasn’t making her do it.”
KJ then allegedly pulled down his pants to expose his genitals and put it into the victim’s mouth.
The victim claimed that KJ “tried multiple times to have sexual intercourse with her by trying to pull down her pants.” She stated that there was “nowhere for her to go, that he had pulled her towards him, always keeping his hands on her body.” He also allegedly “slipped his hands into her shorts.”
The victim told police that she “kept trying to get away and finally succeeded,” at which point KJ pulled up his pants and left the scene.
The victim reluctantly attended school the following day, but she left after seeing KJ’s girlfriend and told her grandmother what had happened at the gym.
She also told police that she had previously kissed KJ “consensually.”
According to officers, KJ and the victim were both seen on surveillance video going into the family dressing room. About 20 minutes later, the victim exited the dressing room and headed toward the lobby, while KJ made his way to the sauna alone.
Test results concluded there was no presence of male and human DNA in the victim’s private area and mouth, per the report.
KJ was arrested on Monday, August 17, and charged with aggravated sodomy and aggravated sexual assault, according to court records obtained by Us. A judge did not set bond, and a preliminary hearing was scheduled for September 8. KJ is currently being held at the Metro Regional Youth Detention Center.
Zolciak broke her silence on her son’s arrest in a statement shared with Us on Friday.
“The allegations being made against my son are nothing short of reckless and deeply troubling. He categorically denies ever being involved with this woman or engaging in the conduct she has alleged,” she said. “My son voluntarily took a polygraph examination regarding these allegations and passed. Additionally, an examination was conducted, and no DNA belonging to my son was found.”
“False accusations can have devastating consequences not only for the person being accused, but also for genuine survivors of sexual assault and abuse,” she continued. “Every legitimate allegation deserves to be taken seriously and investigated based on the facts and evidence. At the same time, no one should be publicly condemned based solely on an accusation.”
Zolciak concluded, “We remain confident that the facts and evidence will establish the truth, and we ask that people allow the proper process to take its course rather than spreading unproven allegations.”
