As previously reported, Jenner was involved in the four-car accident that occurred on Pacific Coast Highway in Malibu, Calif., after rear-ending a 69-year-old woman who had collided with another car and was then pushed into oncoming traffic. The woman, who has since been identified as Jenner’s Calabasas neighbor Kim Howe, was pronounced dead at the scene.

Following the accident, which left five others with injuries, Jenner willing took multiple sobriety tests, including an on-site breathalyzer and a blood test at a hospital. He also offered up his phone records to show, as Jenner’s rep told the Associated Press, that he had not been using his phone. (A previous version of this story said there was a warrant for the records, which is not the case.) "The evidence will show that Bruce was not texting at the time of the accident,” his rep Alan Nierob said late Sunday night.

TMZ, however, reports that the former Olympian may have been following the car too closely, which is a traffic violation. According to California traffic laws, the violation that results in the death of another motorist could be grounds for misdemeanor vehicular manslaughter.

Jenner, for his part, is “devastated,” a source tells Us. Kris Jenner’s ex-husband also expressed his sympathies in a statement over the weekend.

“My heartfelt and deepest sympathies go out to the family and loved ones, and to all of those who were involved or injured in this terrible accident,” the 65-year-old said in a statement to Us. “It is a devastating tragedy and I cannot pretend to imagine what this family is going through at this time. I am praying for them. I will continue to cooperate in every way possible."
