Kate Gosselin has issued a statement about her ex-husband Jon's plans to sue for primary custody of their eight kids.

"I am not willing to comment in public on the custody discussions regarding my children," Gosselin, 35, said. "What I will say is this: I am and always will be a mother first, but as a single working mom I will do everything necessary to provide for my kids despite the opinions of others."

Earlier Tuesday, Jon Gosselin's attorney Anthony F. List told TMZ that Kate is "an absentee mom," whose stint on Dancing with the Stars prohibits her from spending "quality time" with twins Cara and Mady, 9, and sextuplets Aaden, Alexis, Collin, Hannah, Joel and Leah, 5. Jon may also seek spousal support from Kate; Jon currently pays Kate $22,000 a month in child support, a fee List calls "ridiculous."

Kate's attorney Mark Momijan told RadarOnline that the suit is "reckless" and "offensive." "Kate is a devoted mother," Momijan said.

The night before this lawsuit was announced, Kate gushed about her kids from the DWTS set.

"They are hanging on every dance, every dance move," Gosselin, 35, told Entertainment Tonight on Monday. "They are so proud of me."

Kate spoke with her children half an hour before Monday's show time. "They were getting their popcorn ready and they were ready to watch," at home in Wernersville, Penn., she said.

Meanwhile, on Monday's show, Gosselin scored a dismal 15 points for her "Paparazzi" routine; Carrie Ann Inaba complained that the paso doble was "odd" and "very hard to watch, and Bruno Tonioli cracked that she "had the look of the super bitch from hell!"

"Please vote for us!" Gosselin later pleaded to ET. "I don't want this experience to be over before I have learned the lesson that I have set out to learn..My fear isi that I'll leave too soon, and there will always be a question mark in my mind, like 'what could I have done?'"

The controversial mom also acknowledged the votes and supportive emails from fans. "Thank you so much," she gushed. "It makes me cry…The fact that people care so much is so amazing to me. and i appreciate that. because that's what makes me be able to be out and do it."
