Charlie Kirk’s accused killer, Tyler Robinson, is not due back in court until September as his preliminary hearing concludes.
State District Judge Tony Graf adjourned the hearing on Friday, July 10, after the prosecution and defense finished presenting evidence. The proceedings are now set to resume on September 1, when both sides will make their final arguments about whether Robinson, 23, should stand trial, according to AP News.
The break will allow time for attorneys to write legal briefs.
Following the conclusion of the preliminary hearing on Friday, Charlie’s widow, Erika Kirk, filed a request for the court to “promptly enter its probable cause determination based on the overwhelming evidence presented during the five-day preliminary hearing,” according to court paperwork obtained by Us Weekly.
“A prompt determination is imperative in the interest of justice,” the paperwork read. “The Court is approaching the one-year anniversary of Charlie Kirk’s death. Ten months have passed since the defendant was arrested, and the preliminary hearing has now concluded. The defendant is entitled to a fair trial, and he must receive one. He is not, however, entitled to cause undue delay in the criminal justice process.”
Charlie’s family also released a statement following the hearing’s end.
“The conclusion of the preliminary hearing marks an important step forward in the pursuit of justice for Charlie,” the statement read. “Our family is grateful for the prayers, support, and kindness that has been extended to us, especially through these unimaginably painful and emotionally demanding proceedings.”
The family continued, “As difficult as these last few days have been, it brings our family comfort to know that the world has witnessed the overwhelming evidence of what occurred to Charlie that day.”
The statement concluded, “Nothing will ever undo the loss of our beloved Charlie. As this case moves into its next phase, we pray that truth will continue to be heard through a process that is fair, transparent, and grounded in the facts.”
Ahead of the proceedings, which began on Monday, July 6, Charlie’s family — including Erika, 37, his parents, Robert and Kathryn, and sister, Mary — spoke out in a joint statement shared via X.
“Charlie was a beloved husband, son, brother, friend and father,” the statement read. “Every court proceeding serves as a painful reminder of his death and the loss that has irrevocably impacted our lives and the lives of his children.”
Charlie’s loved ones remain “deeply grateful for the support, prayers and kindness we have received. This outpouring has sustained us during the darkest days of our lives.”

“Out of respect for the judicial process, we will not be commenting further at this time,” the statement concluded. “We ask for continued privacy as we navigate this process and immense grief.”
Following the family’s statement, Erika, 37, was spotted attending the preliminary hearing alongside Charlie’s parents.
The hearing came 10 months after Charlie was shot while speaking at Utah Valley University in Orem, Utah, in September 2025. The Turning Point USA cofounder was transported to Timpanogos Regional Hospital, where he later died. He was 31.
Two days after Charlie’s death, Robinson turned himself in to police. He has yet to enter a plea to the aggravated murder charge against him.
During the preliminary hearing, prosecutors revealed previously unseen campus surveillance footage of Robinson speaking with Charlie’s staff at Utah Valley University before returning in different clothes to allegedly shoot the activist from a rooftop.
Meanwhile, Robinson’s defense team used the hearing to question the reliability of DNA testing used to link him to the suspected murder weapon and to push back on the prosecutors’ claim that Robinson targeted Charlie due to his politics.
Erika — who married Charlie in May 2021 and shared two children with him — previously addressed Robinson in an emotional eulogy during her late husband’s September 2025 public memorial service.
“My husband, Charlie, he wanted to save young men, just like the one who took his life,” she said at the time.
“Our Savior said, ‘Father, forgive them, for they know not what they do.’ That young man … I forgive him,” she added through tears. “I forgive him because it was what Christ did, and it’s what Charlie would do.”
Erika then shared a message of hope with her fellow mourners.
“The answer to hate is not hate,” she said. “The answer we know from the gospel is love and always love. Love for our enemies and love for those who persecute us.”
