Dorit Kemsley is accusing her estranged husband, Paul “PK” Kemsley, of having nefarious intent while attempting to sell their family home amid the pair’s ongoing divorce.
In court documents obtained by Us on Monday, July 27, Dorit, 50, alleged that PK, 58, is trying to “egregiously misuse Family Code 2108” in an attempt to “side-step trial” and continue to allegedly forgo making their mortgage payments, claiming his alleged attempts would render both her and their shared children without a home.
The Real Housewives of Beverly Hills star’s attorney argued that Family Code 2108 was “never intended to permit the sleight of hand that PK is weaponizing to render his wife and children homeless.”
Dorit alleged that PK promised to pay their bills — including the mortgage — after he moved out of their marital home in May 2024 after nine years of marriage in lieu of paying formal child support.
She claimed that PK has failed to live up to his alleged promise, and as a result is asking a judge to award her $22,330 per month in spousal support and $21,086 per month in child support. (The exes share two children, son Jagger, 12, and daughter Phoenix, 10.)
Dorit also asked the judge to deny PK’s request to sell their home, noting she and the children still live in the house.
Her attorney noted that Family Code 2108 does allow for an “extremely rare pre-trial carve-out” for the sale of a marital property if “there is an immediate risk of market/investment loss,” to which Dorit claimed was not the case for her and PK’s property.
“In fact, there is no emergency or risk of loss in this case that would permit the pretrial sale of the marital residence before the court has even had a chance to make orders for PK to pay Dorit child and spousal support,” Dorit’s lawyer alleged.
The attorney claimed that “forcing the improper sale” of their home before trial is an “abusive ex parte practice” on PK’s part, claiming it would render Dorit and their children “homeless.”
Dorit also alleged in the docs that PK has the means to pay the mortgage and support but was allegedly choosing to spend his money on his own lavish lifestyle.
She called PK a “runaway” spender, claiming he had spent $756,000 over the course of a few months.
Dorit’s legal team alleged that PK spent $55,000 on clothing, including Hermès and other luxury brands, $75,000 on meals and dining and withdrew $103,000 in cash.
In addition to her request for spousal and child support moving forward, Dorit is asking the court to make PK retroactively pay her $347,000 in support. The reality star also asked the judge to sanction PK for his alleged actions in the sum of $40,000.
Dorit’s filing comes after PK previously claimed that she spent $1 million on luxury goods and clothes while filming RHOBH.
Dorit addressed the allegations in her filing, claiming she spent $217,000 for Season 15 and $500K on previous seasons, which added up to around $713,000 over a 26-month period, all of which she said was necessary to be “camera ready.”
She argued that PK’s accusations of overusing funds for clothing did not account for the charges that she “later refunded or credited back to her account” when they weren’t used.
Dorit’s attorney alleged that PK’s “financial struggles are invoked only when he is asked to support his wife and dependent children.”
The legal team further claimed that the “evidence” of PK’s spending “demonstrates that this purported financial emergency is not the product of financial necessity, but rather of PK’s own decision-making.”
