Jared Fogle’s wife, Katie, filed for divorce from the former Subway spokesperson on Wednesday, Aug. 19, the same day the U.S. attorney’s office released documents alleging the 37-year-old had solicited underage sex and had received child pornography. According to divorce documents obtained by Us Weekly, the mother of two also listed their date of separation as that same day.

In the divorce filing, Katie claims their split is due to “an irretrievable breakdown of the marriage” and “requests that the court determine all child related issues, including custody, parenting time, child support, and education expenses as part of the final order,” and “requests a custody order that serves the best interests of the parties’ children.”

The couple, who married in July 2010, share a son named Brady, born in 2011, and a daughter named Quinn, born in 2013.

Katie, who is Jared’s second wife, is also requesting that the court “enter appropriate orders to divide and distribute the parties’ marital estate.”

"Obviously, I am extremely shocked and disappointed by the recent developments involving Jared. I am in the process of seeking a dissolution of the marriage," Katie said in a statement on Wednesday. "My focus is exclusively on the well-being of my children. Neither I nor my family will have any further comment on the matter. I appreciate respect for my family's privacy during this difficult time.”

As previously reported, Jared was charged with one count of travel to engage in illicit sexual conduct with a minor and one count of distribution and receipt of child pornography. Court documents allege that he traveled between Indiana and New York City to engage in sexual acts with minors as young as 16 between 2010 and 2013, and in a text message conversation stated that “the younger the girl, the better.” Under a plea deal entered on Wednesday, he agreed to serve at least five years in prison and pay a restitution of $1.4 million and register as a sex offender.

Russell C. Taylor, the head of The Jared Foundation, is also allegedly involved in the case. He is accused of sending Jared photos and videos obtained from a hidden camera in his home featuring children as young as 6.

In July, the FBI raided Jared’s Indianapolis home regarding allegations of child pornography. Following the scandal, Subway also cut ties with the former weight loss champ.
