Kevin Roper, the Walmart truck driver who slammed into Tracy Morgan’s limo van, killing passenger James McNair and severely injuring Morgan in June 2014, has been indicted by a grand jury.
Roper was charged on Wednesday, December 23, with first-degree aggravated manslaughter, second-degree vehicular homicide and eight counts of third-degree aggravated assault charges.
As previously reported, Roper had allegedly been awake for more than 24 hours when his Walmart truck plowed into Morgan’s vehicle on the New Jersey Turnpike. The crash left comedian McNair dead and several others injured. Morgan, 47, spent more than a year recovering from broken bones and a serious brain injury (he was in a coma for two weeks), and returned to the stage for the first time last October for Saturday Night Live’s 30 Rock reunion.
According to a National Transportation Safety Board investigation this past August, Roper hadn’t slept for 28 hours and failed to slow down immediately before the crash even though there were warning signs posted.
