Sam Shepard was arrested on Memorial Day, May 25, on suspicion of drunken driving, the Associated Press reports. He was in Santa Fe, New Mexico, at the time.
According to the AP, security personnel at La Choza restaurant called police shortly before 8 p.m. to report a possibly intoxicated driver. Shepard was apparently in his truck, but was struggling to disengage the emergency brake.
The Bloodline actor, 71, told officers he'd had two drinks. "Our officer could smell alcohol on his breath, and he had bloodshot, watery eyes," Santa Fe police Lt. Andrea Dobyns told the AP.
Dobyns added that the Pulitzer Prize winner had failed a field sobriety test after declining a breath test. As of Tuesday afternoon, he was still in custody at the Santa Fe County Jail.
This is not Shepard's first run-in with the law. According to the AP, he also pleaded guilty to drunken driving charges back in 2009, after which he had to complete an alcohol treatment program and community service.
