Erika Jayne Claims Tom Girardi Didn’t Deny Cheating on Her After She Found ‘Evidence’: He Was ‘Sloppy’

Even more to the story? Erika Jayne accused her estranged husband, Tom Girardi, of cheating on her as she continued to break down over their legal woes on The Real Housewives of Beverly Hills. The Wednesday, July 20, episode of the Bravo hit was filmed in December 2020 shortly after news broke that a judge froze Tom’s assets amid his bankruptcy case and allegations that he and Erika, 50, embezzled settlement funds from his clients. “It’s not OK and it’s not going to be OK for a long time,” Erika said through tears after she arrived at Kyle Richards’ Palm Springs home for a getaway with Dorit Kemsley, Lisa Rinna, Sutton Stracke, Kathy Hilton and Crystal Kung Minkoff. In a confessional, she added, “Every day I wake up and there’s something new and it’s not good. It’s actually terrible. It’s all bad news all the time.” During a group dinner, Kyle, 52, admitted that she heard Tom cheated in the past. “There’s always gossip about everybody all of the time. And there was nothing solid, just rumblings. It wasn’t even a solid story,” the former child star told Bravo cameras. “I certainly would never picture Tom cheating on Erika. She told her castmates that she had “never” gone through his phone or belongings until Yolanda Hadid split from David Foster in 2015. “After Yolanda divorced David, I just opened that phone and I was like, ‘Wow, OK,'” Erika said, claiming she found “evidence,” including text messages and pictures of a “years-long” affair. “I knew a lot because it was so hard to hide and, you know, he was sloppy.” When asked whether Tom, 82, “denies being a cheater,” Erika said, “Nope.” “Why did you not leave if you knew he was cheating on you?” Kyle inquired, to which Erika responded, “Where am I going? … He told me straight up, ‘This is my house.’ Where am I going?” She concluded, “I will be OK, but I am not OK right now.” The Pretty Mess author made headlines in December 2020 when she posted (and later deleted) alleged messages between Tom and a California judge. “This is Justice Tricia A. Bigelow. She was f–king my husband Tom Girardi and he was paying her Saks bill and paying for her plastic surgery,” she wrote at the time. While Tom’s team never responded to requests for comment regarding the cheating allegations, a lawyer for Bigelow called Erika’s “actions in maliciously doxxing the Justice … nothing short of criminal,” noting “we are considering our options to protect Justice Bigelow from further harassment.” The Real Housewives of Beverly Hills airs on Bravo Wednesdays at 8 p.m. ET. The Ladies React to Tom’s Frozen Assets

“The government froze all of his assets because it was determined that at least $2 million was used inappropriately,” Dorit told Kyle and Lisa. “You cannot touch [your money].”

The Melrose Place alum added, “The most disturbing part of it is the $2 million that was supposed to go to the orphans and victims of the plane crash.”

Tom’s Health

When asked whether she’s talking to Tom, Erika replies, “Absolutely not. When I left, I left and that’s it. And that hurts too. … That’s very hard because you’re married to somebody for 20 years and you know they’re struggling and you know they’re not in a good place, but I’m actually in some ways very relived. His attorney said that she feels that he is not mentally well. This is something that I have said and no one would listen to me. And maybe finally he can get the help he needs.”

In a flashback to last week’s conversation with Kyle, Erika claims she tried to tell Tom there was something wrong with his sight and hearing: “You’re f—king degrading in front of me and you’re ignoring it.”  

“What I was seeing, what I was experiencing, what I was hearing, I was right. Tom was changing, you know, this was over time,” Erika added in a confessional. “When you’re slowing watching someone unravel, that’s a hard time to do.”

During a group dinner later in the episode, Erika told her costars that it’s time for Tom to stop practicing law. “Love him, but it’s time because he’s not well. You’ve got to stop," she said. ”Tom’s sole identity is being a great lawyer. That’s all he ever wanted to be in life and he put that ahead of everything, everything. These last few years, you know, when I noticed him declining, I think he held on even tighter. I think he was afraid, I think that he was mad because he was mean as f—k.” (Us confirmed in March that Tom lost his law license after he was diagnosed with Alzheimer's.)

Tom's Car Accident

In 2017, Erika told her costars that Tom was in a car accident and broke his ankle. During Wednesday’s episode, she claimed that he had a head injury, broke his shoulder, snapped his ankle and had more injuries after driving off a cliff. “Now that everything has come to light, I can kind of tell,” she said. “He was down the hill. … out of the car [when I found him].”

The Clubhouse

Erika turned in the keys for her “clubhouse” a.k.a office during Wednesday's episode. “Since I left, I have not received one a dime from Tom Girardi, despite what everyone seems to think,” she said. “I’m a budget. It can be challenging, yes. At times? Horrible. But I can take care of myself. People forget that. People want to forget that.”

Erika later admitted to her costars she doesn’t know “what happens” with her singing career. “It’s an expensive business,” she said.

The Spousal Support

Erika claimed that she’s been financially independent since she left Tom in November 2020. While Dorit said that she “hated” reading that Tom didn’t want to give her spousal support, Kathy noted that the “richest man in the world will try to take the jewelry back.” Erika noted how “tacky” it was before admitting, “I don’t know that there’s anything to get.”
