Kelly Rutherford Receives Restraining Order Against Husband

Gossip Girl star Kelly Rutherford was granted a temporary restraining order against her estranged husband, Daniel Giersch, Usmagazine.com has learned.
The star, 40, claims the German entrepreneur has repeatedly harassed her and her family -- including her mother and her nanny -- according to documents filed at L.A.'s County Superior Court.
She alleges that he has followed them and "shows up unexpectedly to threaten and scare us," the order, which is in effect for 21 days, says.
"I am pleased with the court's decision in connection with the custody case, and I feel the order is in the best interest of my children," the actress told Us in a statement Friday.

Since splitting last year, the couple has been involved in a bitter custody battle over son, Hermes, 2, and daughter, Helena, 3 months.
A hearing date to review evidence is set for Oct. 15.

The men might not be good fathers but that doesn't excuse the woman for creating a baby with them when they knew this the first time around.
I like her....He's always been causing her aggravation! I'd get a restraining order too....I have a bad feeling about this....I hope she gets an extention....we all know how those restraining orders work tho....just a piece of paper in SOME ppl's mind.

This woman is going to destroy her children to spite her ex. No suprise to me she is embarrassing the family once again with a "restraining order." Anyone can get one, you know. Last time, she went to court over potty training issues. He needs to document everything. She's a nut.
Anonymous 12:12am.........It's not hard to obtain a temporary restraining order (like she has). I work in the court system, and to obtain a temporary is a pretty routine procedure. Now, obtaining a Final Restraining Order is more difficult. Once you get a temporary, you're then set up for a hearing at Family Court and in order to get a Final RO, you have to show evidence as to why you feel you need a restraining order. I think she's unstable. I'm the last person to talk out against a victim, but I don't think that's what she is AT ALL. What woman takes her husband to court because he's trying to potty train their child!! The only people I feel bad for here are those poor children.

getting a RO takes a bit of work and would not be issued if there was no proof/facts to back up her claim. i think any woman who would leave her husband while pregnant has real reasons for it. i hope she has a good support system and that people are watching out for her. (also the whole potty training thing - i'm positive that there was more to that story as well, they were in court to discuss the issue which means it was serious)
The woman is only three months postpartum and that jackass is causing her all of this stress and fear? He should cool his heels in jail for the next 12 months.

This is the same woman who took her ex to court because he was teaching their 2.5 year old to use the toilet. She is the psycho and is probably delusional as well. She is the control freak!

I think she has cause for the restraining order. If you go on e-online, you will get more details on what this nutcase is doing to her and her nanny. I don't think that stalking is somrthing that should be taken lightly. He is more of a headcase than her. I see a possiblr tragedy in the near future. i also think she has every right to be concerned about his taking off with the kids to germany or wherever he is from. This is a control thing for him. He wants to keep a connection to her and he is using the kids to get her attention.
