Pregnant Desperate Housewives star Marcia Cross, 44, is trying to keep some not-appropriate-for-children nude photos of herself under wraps.
According to the New York Daily News’ Rush & Molloy, a carting firm hired to remove trash from Cross’ L.A. home found more than 200 personal photographs of the actress in the trash, and is now trying to sell them for profit.
Phoenix-based agent David Hans Schmidt is representing the owner of the carting firm that discovered the photos when it got to the local city dump.
"There are some pictures of her showering outside," Schmidt tells the News. "She looks absolutely gorgeous. And yes, the carpet does match the curtains." (Was that really necessary?)
Cross is demanding their return. Her lawyers argue that no matter where the photos were found, they are the copyrighted property of Cross and her husband, Tom Mahoney, who may have taken some of them. Cross' attorneys insist that the photos were tossed out by mistake.
"The pictures were not stolen," says Schmidt. "When you throw something away, you forfeit that property.
"We recognize the copyright issue, but U.S. copyright law stops at the border," adds Schmidt, who may be planning to sell the shots abroad.
Earlier this year, Schmidt acquired the embarrassing contents of Paris Hilton’s storage locker, which went up for public auction after the heir-head failed to pay her rent. Just as he did for Hilton, Schmidt has invited Cross to buy back her trash for an undisclosed sum.
"I'm not looking to mortify Ms. Cross," says Schmidt. "I just want the most money for my client."
Schmidt says his client also found Cross' tax returns amid the debris. "I know how much she made, but out of respect for Ms. Cross, I won't discuss it," he says.
Cross and Mahoney, 48, were married last June. They're expecting twins in April.
