Marcia Cross’ Ladybits to Become a Matter of Public Record

Pregnant Desperate Housewives star Marcia Cross, 44, is trying to keep some not-appropriate-for-children nude photos of herself under wraps.

According to the New York Daily News’ Rush & Molloy, a carting firm hired to remove trash from Cross’ L.A. home found more than 200 personal photographs of the actress in the trash, and is now trying to sell them for profit.
 
Phoenix-based agent David Hans Schmidt is representing the owner of the carting firm that discovered the photos when it got to the local city dump.
 
"There are some pictures of her showering outside," Schmidt tells the News. "She looks absolutely gorgeous. And yes, the carpet does match the curtains." (Was that really necessary?)
 
Cross is demanding their return. Her lawyers argue that no matter where the photos were found, they are the copyrighted property of Cross and her husband, Tom Mahoney, who may have taken some of them. Cross' attorneys insist that the photos were tossed out by mistake.
 
"The pictures were not stolen," says Schmidt. "When you throw something away, you forfeit that property.
 
"We recognize the copyright issue, but U.S. copyright law stops at the border," adds Schmidt, who may be planning to sell the shots abroad.
 
Earlier this year, Schmidt acquired the embarrassing contents of Paris Hilton’s storage locker, which went up for public auction after the heir-head failed to pay her rent. Just as he did for Hilton, Schmidt has invited Cross to buy back her trash for an undisclosed sum.
 
"I'm not looking to mortify Ms. Cross," says Schmidt. "I just want the most money for my client."
 
Schmidt says his client also found Cross' tax returns amid the debris. "I know how much she made, but out of respect for Ms. Cross, I won't discuss it," he says.
 
Cross and Mahoney, 48, were married last June. They're expecting twins in April.

This guy is sleazy and his actions are horrible. It's also pathetic that he has nothing better to do than to dig around in trash. That said, this is a good lesson in being careful with what you throw away. Marcia has no rights to them any more and she really should have been more careful. She should just not make a big deal about it--that makes the buzz happen. Those pictures sound like they are tasteful nudity, not porn shots, so it really isn't that bad to her image. I just hope that they are not used for bad things. I also think she shouldn't pay this guy one penny.

She should just brazen it out. The more fuss she makes the bigger the buck he will make - Im sure she will have learnt a lesson about ensuring that photo's taken in private should remain private and will from now on make a new "private" photo album that is kept under lock and key.

All I have to say is, learn to burn your trash, litterally!! Burn your trash!! If the trash is burned, there are no pictures, tax forms, NOTHING, that people can use against you. I learned the hard way!

So she should do as others have done before her and say "so what"? and downplay it as a big deal.

I personally have no desire to see her nude- and for those that do: it's a naked woman. Whoopty Doo.

if i were a celbrity i would NEVER take naked pictures of myself.....it never leads to good things. i refuse to feel sorry for her because she was stupid and just threw out pictures that could be used to hurt her. when will these celbs learn, if you're going to get naked and record it make sure it never leaves your home!!! stupid stupid stupid!

I can't believe anyone would actually throw nude photos OR a tax return in the trash!! I'm sure she can afford a paper shredder. Tossing stuff like that in the trash is just asking for trouble.

2. if you are a celebrity, you DONT hire someone to pick up your trash. thats just asking for it.

She shouldn't make a huge deal out of it. I understand she's pregnant, but these sound like innocent photos and nothing to be ashamed of. The more attention she gives it the higher it drives the price of the photos. I promise not to buy anything with them printed should they be used for evil.
